Case Transfers & Case Actions
When recording a case transfer in the GTS, you need to add one of two case actions depending on whether your court office is acting as the receiving or sending county.
The receiving county, or the county in which the case is being moved to, should use the Petition for Acceptance of Guardianship Transfer case action when the case is being created in the GTS. The subject of the guardianship has likely already been adjudicated as incapacitated so the other case initiating case actions (i.e. Petition or Adjudication of Incapacity and Appointment of Guardian and Emergency Petition for Adjudication of Incapacity and Appointment of Guardian) do not apply. Following case creation, any subsequent case actions and other case information can be recorded in the GTS just like any other case managed by the county.
The sending county, or the county in which the case is being transferred from, should only record a case action if the receiving court accepts the new case. In this scenario, once the receiving court provides the provisional order, the sending court should record the Final Order of the Court - Case Transferred case action. This action closes the case. There is no need for the sending court to record a case action in the GTS that signifies the petition was filed, regardless if the transfer was accepted by the receiving county.
